Terms of Service
These Terms of Service govern access to and use of BI Social Publishing, a social publishing service powered by Postiz and operated by BOE International Consulting LLC, including the public website, the authorized publishing application, connected account workflows, and related services.
1. Acceptance of these Terms
These Terms of Service are an agreement between the user and BOE International Consulting LLC. By accessing or using BI Social Publishing, the user agrees to these Terms and to any applicable policies referenced in these Terms.
If a user does not agree to these Terms, the user must not access or use the service.
2. Service description
BI Social Publishing is a web-based social media publishing workflow for creators, agencies, businesses, clients, and authorized collaborators. It helps users connect supported social media accounts, prepare content, review platform-specific settings, publish content, schedule content, manage drafts, and review publishing status.
The public information website is available at https://site.boeinternational.com. The publishing application is available to users at https://publish.boeinternational.com.
The service is designed as a controlled publishing workspace. It is not intended to bypass platform rules, impersonate users, scrape content, or publish unauthorized content.
3. Authorized use
BI Social Publishing is available to creators, agencies, businesses, clients, and their authorized collaborators. Users may create an account where registration is available or request access from BOE International Consulting LLC. Access controls protect connected accounts and publishing workflows.
- Users must be authorized to access the publishing application.
- Users must connect only accounts, pages, profiles, or channels they own, manage, or are authorized to use.
- Users must have all rights, licenses, approvals, and permissions needed to upload, schedule, or publish content.
- Users must comply with these Terms and with the rules of each connected platform.
4. Accounts and security
Users are responsible for maintaining the confidentiality of their login credentials, access devices, and connected account permissions.
- Users must not share credentials with unauthorized persons.
- Users must notify us if they suspect unauthorized access or misuse.
- Users are responsible for actions performed through their authorized account.
- We may suspend or restrict access if we detect security risks, misuse, or policy violations.
5. Connected social platforms
The service may support workflows for platforms such as TikTok, YouTube, Instagram, Facebook, Threads, LinkedIn, X, Pinterest, Reddit, Bluesky, Mastodon, and other supported social media services.
Each platform has its own terms, privacy policy, community rules, developer policies, content rules, authorization process, account requirements, and technical limitations. Users are responsible for complying with the rules of each connected platform.
We are not responsible for decisions, restrictions, outages, API changes, enforcement actions, content removals, review decisions, account actions, or publishing limitations imposed by third-party platforms.
6. User content and ownership
Users retain ownership of the content they upload, prepare, schedule, or publish through the service, subject to any rights granted to connected platforms when content is submitted to those platforms.
By using the service, users grant BOE International Consulting LLC a limited permission to process, store, preview, schedule, transmit, publish, and troubleshoot user content only as needed to operate the service and complete user-approved workflows.
Users represent and warrant that they have all rights needed for any content they submit, including:
- Images, videos, audio, thumbnails, captions, hashtags, comments, and descriptions.
- Names, likenesses, trademarks, logos, copyrighted materials, and third-party assets.
- Music, sounds, recordings, commercial materials, and campaign assets.
- Any permissions required by clients, collaborators, brands, agencies, or account owners.
7. Publishing workflow and user responsibility
Users remain responsible for reviewing and confirming content before publication. This includes the destination account, page, channel, or profile; the caption; the media; the timing; the privacy or visibility settings; and any platform-specific publishing fields.
- Publishing may be immediate, scheduled, saved as a draft, or otherwise handled according to platform capabilities.
- Publishing results may depend on platform API availability, account permissions, media requirements, and platform review.
- Scheduled content may fail if permissions expire, tokens are revoked, platforms are unavailable, or content violates rules.
- Users are responsible for checking final published content and platform status where appropriate.
8. Prohibited use
Users may not use the service to:
- Publish illegal, harmful, deceptive, abusive, hateful, infringing, or unauthorized content.
- Impersonate another person, company, brand, creator, or organization without authorization.
- Violate intellectual property, privacy, publicity, contractual, or confidentiality rights.
- Publish spam, scams, malware, phishing content, misleading promotions, or manipulative engagement content.
- Bypass platform rules, API restrictions, review processes, access controls, or security systems.
- Connect accounts that the user does not own, manage, or have authorization to use.
- Scrape, copy, mass repost, or automate unauthorized third-party content.
- Interfere with service security, stability, availability, infrastructure, or other users.
9. Fees and paid access
If access to the service is provided under a paid agreement, subscription, client agreement, or project arrangement, fees, billing terms, cancellation rules, and payment obligations are governed by the applicable agreement or invoice.
If no separate paid agreement applies, access may be provided, restricted, or removed at our discretion.
10. Service availability and changes
We aim to operate the service in a reliable and secure manner, but we do not guarantee uninterrupted, error-free, or permanent availability.
We may update, modify, suspend, restrict, or discontinue any part of the service for maintenance, security, compliance, technical, business, or platform-policy reasons.
11. Third-party services
The service integrates with third-party platforms and service providers. Third-party services are not under our control, and their availability, features, API behavior, policies, and account requirements may change at any time.
We are not responsible for third-party service outages, policy changes, rejected posts, platform rate limits, API failures, account restrictions, content removals, or other actions taken by connected platforms.
12. Our intellectual property
The service, website, interface, design, documentation, workflows, branding, and related materials are owned by BOE International Consulting LLC or its licensors. Users may not copy, modify, reverse engineer, resell, sublicense, or exploit the service except as expressly permitted.
13. Privacy
Use of the service is also governed by our Privacy Policy, which explains how we collect, use, store, and protect information in connection with the service.
The Privacy Policy is available at https://site.boeinternational.com/privacy-policy/.
14. Disclaimers and limitation of liability
The service is provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, error-free operation, and platform availability.
To the maximum extent permitted by applicable law, BOE International Consulting LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, account access, content reach, engagement, or business opportunities.
We are not liable for publishing errors, rejected posts, delayed posts, platform outages, third-party API issues, content moderation decisions, account restrictions, or user-submitted content.
15. Indemnity
Users agree to indemnify and hold harmless BOE International Consulting LLC from claims, damages, losses, liabilities, costs, and expenses arising from user content, unauthorized account use, violation of these Terms, violation of platform policies, infringement of third-party rights, or misuse of the service.
16. Suspension and termination
We may suspend, restrict, or terminate access to the service if a user violates these Terms, creates a security risk, misuses the service, violates platform policies, fails to maintain authorization, or uses the service in a way that may harm users, platforms, infrastructure, or BOE International Consulting LLC.
Users may stop using the service at any time. Disconnecting connected accounts may prevent future publishing, scheduling, or status updates.
17. Changes to these Terms
We may update these Terms from time to time. When we make changes, we will update the “Last updated” date above. Continued use of the service after changes means the user accepts the updated Terms.
18. Governing law
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles, unless a separate written agreement states otherwise or applicable law requires a different result.
Any dispute shall be submitted to the state or federal courts serving Pinellas County, Florida, unless applicable law requires otherwise.
